Es gibt Teile des Grundgesetzes die sind einfach veraltet. Es ist sogar gewollt es ein Stückweit mit 3/4 Mehrheit anzupassen. Es gibt auch einen Grundkern, gegen den man sich nicht aussprechen darf. Wenn ich mir diese Artikel durchlese, kann man da alles mögliche reininterpretieren. Ich würde sogar soweit gehen, dass die SPD & CDU mit ihrem letzten Paket (insb. im Zusammenhang mit Merz’ Aussagen) gegen die Menschenwürde und den besondren Schutz der Famillie verstoßen. Das passiert immer wieder, so hatte die Ampel gegen die Schuldenbremse im GG verstoßen. Ich kann mir vorstellen, dass die AfD mittlerweile juristisch gut genug aufgestellt ist, dass es da keinen Angriffspunkt gibt. Zumindest beim Bundesverband auf dem Papier. Die Richter sind zu Recht auch sehr Zurückhaltend bei Eingriffen in die Demokratie. Bei 20+% Wählern muss man eine Partei auch Inhaltlich stellen. Ein einfaches Verbot könnte zu Unruhen führen oder die Wähler zu einer neuen Partei führen (3. Weg ist wohl 'ne Nummer härter…).
